1. Acceptance
These terms are an agreement between you and DBR Group ([full legal name, registration no., address — fill in before publishing]) for use of the Q-Smoke app. By creating an account or using it you confirm you have read and agree to these terms and the Privacy Policy.
2. Eligibility
You must be at least 18. You provide accurate information, keep your password confidential and are responsible for activity on your account.
3. Q-Smoke is not a medical service
Q-Smoke is a self-tracking and morale-support tool. The app and its AI assistant do not diagnose, treat or replace a doctor's advice. The AI assistant is a computer program and may give incomplete or wrong information. If you have severe withdrawal symptoms, other conditions, are pregnant, or need cessation medication, consult a doctor or a smoking-cessation service. If you have thoughts of self-harm or are in an emergency, contact a medical facility, your local emergency number or someone close to you immediately.
4. AI assistant
By using the AI assistant you agree that your messages and a summary of your smoking data are sent to a third-party AI provider as described in the Privacy Policy. Do not enter unnecessary sensitive information (identity documents, bank details, passwords). You are responsible for deciding whether to follow the assistant's suggestions.
5. Your content
You are responsible for content (notes, photos) you upload and must not upload unlawful photos or photos that infringe others' rights (e.g. photos of other people without permission).
6. Prohibited conduct
- Unauthorised access, vulnerability scanning, or interference with the system or others' data.
- Reverse-engineering, copying or redistributing the app.
- Automation that overloads the service.
- Violating Vietnamese law.
7. Intellectual property
Q-Smoke, its source code, interface, brand and accompanying materials belong to DBR Group or its licensors and are protected by intellectual-property law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app under these terms. You may not copy, reverse-engineer, interfere with, resell or use our brand without written permission.
Content you create remains yours. You grant us a limited, non-exclusive licence to store, process and display it solely to operate the service for you.
8. Suspension and termination
You may delete your account at any time in the app. We may suspend or terminate an account if you breach these terms or at the request of a competent authority, and will notify you beforehand where possible.
9. Disclaimers and limitation of liability
To the extent permitted by law the service is provided "as is"; we do not warrant it will be uninterrupted, error-free or fit for every purpose. We are not liable for indirect damages or data loss caused by your device, network or actions, and our aggregate liability (if any) will not exceed the amount you paid for the service in the previous 12 months. This limit does not apply to liability that cannot be excluded by law (including consumer-protection law) or that arises from our wilful misconduct or gross negligence.
10. Apps from stores
If you obtained the app from the App Store or Google Play, Apple Inc. / Google LLC is not the provider of the app and has no responsibility for its content, warranty, support or claims relating to it; the store's standard terms apply in parallel. Apple is a third-party beneficiary of these terms for the iOS version.
11. Governing law and disputes
These terms are governed by the laws of Vietnam. Disputes are first resolved by negotiation; failing that, the competent court in Vietnam has jurisdiction. If you are a consumer, your mandatory rights under consumer-protection law are not limited by these terms.
12. Changes to the terms
We may update this document when the product or the law changes. Material changes will be announced in the app or by email before they apply; the update date is shown at the top. Continuing to use the service after the effective date means you accept the new version, unless the law requires us to obtain your consent again.
